National Ombudsman Commission Recommended Bogor Administration Revoke its 2011 Decree

JAKARTA (INDONESIA) - The National Ombudsman Commission recommended that the Bogor administration revoke its 2011 decree on Monday that annulled a church construction permit granted to the Yasmin Indonesian Christian Church (GKI Yasmin).

“According to the law, the Bogor city administration is required to report to the Ombudsman Commission about the implementation of its recommendation within 60 days after the administration received the recommendation,” Ombudsman representative Budi Santoso said on Monday.

Budi said that the Ombudsman Commission proposed the recommendation after conducting a study of GKI Yasmin’s case.

“We found an administrative mistake in the GKI Taman Yasmin case, as the mayor issued a decree to annul the church construction permit on March 11, 2011. It is a mistake, negligent of the law and contrary to the decision of the Supreme Court,” Budi said.

On March 11, 2011, the Bogor city administration issued a decree to annul a previous decree that granted a construction permit to GKI Yasmin to build its church in Taman Yasmin, Curug Mekar subdistrict, Bogor, West Java. The administration decision was contrary to a Supreme Court verdict on Dec. 9, 2010, which overturned the Bogor administration’s request to uphold a lower court decision to shut down the church.

Bogor administration secretary Bambang Gunawan said the administration would try to fulfill the recommendation.

“We will study the recommendation and try to implement the recommendation optimally,” Bambang said.

Ombudsman Commission chairman Danang Girindrawardana said the GKI Yasmin case would be elevated on the political chain if the Bogor administration failed to fulfill the recommendation.

“A recommendation is the highest order the Ombudsman Commission can issue. If the Bogor administration fails to fulfill it in 60 days, we will leave it to the highest political mechanism, the provincial administration, Home Affairs Ministry and probably to the House of Representatives and the President,” Danang said.

He said that the Ombudsman Commission would monitor and maintain cooperation with the Bogor administration to carry out the recommendation.(Jakarta Post)
